3. Engagement Terms
All consulting, advisory, and managed security engagements are governed by separate engagement letters or statements of work executed between Phylaxion and the client. These Terms of Service govern only your use of this website. No client relationship is established by browsing the Site, submitting a contact form, or downloading resources.
Engagement-specific terms, including scope, pricing, confidentiality, and liability limitations, are defined in the applicable engagement letter. In the event of any conflict between these Terms and an executed engagement letter, the engagement letter controls.
4. Use of the Site
You agree to use the Site only for lawful purposes. You agree not to:
- Attempt to gain unauthorized access to any portion of the Site, its systems, or connected networks
- Use the Site to transmit malicious code, malware, or any material designed to disrupt or compromise systems

Communications through this Site (contact forms, email) are not encrypted end-to-end. Do not submit sensitive security findings, vulnerability details, credentials, or other confidential information through the contact form. If you need to share sensitive information, we will establish a secure channel during initial consultation.
8. Limitation of Liability
To the maximum extent permitted by law, Phylaxion Security LLC, its owner, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, reliance on any content published on the Site, or inability to access the Site.
Our total liability for any claim arising from your use of the Site shall not exceed the amount you paid to Phylaxion in the 12 months preceding the claim, or $100, whichever is greater.
This limitation does not apply to liability arising from an executed engagement letter, which is governed by the terms of that agreement.

The Site and all content are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We do not warrant that any security advice or content on the Site will prevent security incidents.
10. Indemnification
You agree to indemnify and hold harmless Phylaxion Security LLC, its owner, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Site, violation of these Terms, or violation of any applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Denver County, Colorado.
12. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
